Essex County Superior Court Judge Michael Giles has issued arrest warrants for former NJ Devil Ken Daneyko and former NY Giant Bart Oates for contempt of court. The two former pro athletes have been found in civil contempt for missing four depositions in a real estate lawsuit.
“I don’t feel good about doing this,” attorney Bruce Nagel said. “I would like these guys who were heroes in the sports world to make good on their word and step up to the plate in this case.”
The players’ attorney Joseph Castelluci could not be reached for comment.
The Star-Ledger explains the case against the players (we put the whole thing in quotes because we still haven’t figured out how to do the indenting thing):
“Nagel said he represents Cary Heller, a Short Hills investor who loaned $300,000 to the two players and a third man, Michael Gallagher, in September 2006 for a highrise hotel and condomium complex planned for Wildwood.
Nagle said the players’ partnership, Pro Re Developers Wildwood 1, would have been among the developers in the project, but he said it has not gotten off the ground. He said the three men failed to repay the loan as promised.
He said they had paid only $150,000 when Heller filed suit in March 2007. Nagel said he was able to obtain a default judgement against the three in June after they failed to contest the lawsuit.
“They owed the money, and there was no defense,” he said.
Nagel said he sought the depositions to learn the location of their assets. He said he has filed liens against some of their holdings, including Daneyko’s home on Combs Hollow Road in Mendham and Oates’ home on Silverbrook Road in Morristown.”
